Terms of Service — Scout the Shot

These Terms of Service (“Terms”) govern your use of the Scout the Shot app and website, operated by Focal Works LLC, doing business as Scout the Shot (“we,” “us,” “our”). By using Scout the Shot, you agree to these Terms.


1. What Scout the Shot does

Scout the Shot helps photographers search for, save, and plan around photography locations, including ZIP code and GPS-based search, saved location libraries with reference photos, golden hour and blue hour calculations, and shoot planning tools.


2. Accounts

You may need an account to save locations, sync across devices, or make purchases. You’re responsible for keeping your account credentials secure and for all activity under your account. Let us know right away if you believe your account has been accessed without your permission.


3. Purchases

Scout the Shot offers two separate products:

Purchases made through the Apple App Store or Google Play are billed and refunded according to Apple’s and Google’s own policies, not ours directly — refund requests for those purchases should generally go through the app store you purchased from. Purchases made directly through our website are processed by Stripe.

You can cancel a Search Pro subscription at any time through Settings, or through your app store subscription management. Cancelling stops future billing; it does not retroactively refund the current billing period unless required by law or app store policy.

We may suspend or terminate accounts that violate these terms.


5. Your content

Reference photos, notes, and Planner details you save in the app remain yours. By uploading content, you give us a limited license to store, sync, and display that content back to you as part of providing the app’s features — we don’t use your saved content for any other purpose, and we don’t claim ownership of it.

You’re responsible for having the right to save and upload any photo or note you add to the app, and for the legality of visiting and photographing any location you scout, including respecting private property, permit requirements, and local regulations. Scout the Shot provides information to help you plan, but doesn’t verify legal access, safety conditions, or permit requirements for any location — that responsibility is yours.


6. Third-party services

Scout the Shot’s search features rely on third-party services, including Anthropic’s Claude API for AI-powered search, and Flickr, Wikimedia Commons, Mapillary, and iNaturalist for location photos, and Nominatim/OpenStreetMap for geocoding. Payment is processed through Stripe, Apple, or Google. We aren’t responsible for the availability, accuracy, or content of these third-party services, and your use of them through our app is also subject to their own terms.


7. Disclaimers

Scout the Shot is provided “as is.” Search results, location suggestions, golden hour calculations, and any other information the app provides are intended to help with planning, but we don’t guarantee their accuracy, completeness, or that any specific location is safe, legal, or accessible to visit. Always verify conditions and permissions independently before relying on the app for a shoot.

We don’t guarantee the app will be uninterrupted, error-free, or available at all times.


8. Limitation of liability

To the extent permitted by law, Focal Works LLC isn’t liable for any indirect, incidental, or consequential damages arising from your use of the app, including issues arising from relying on location, light, or planning information the app provides.


9. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll notify you through the app or by other reasonable means before the changes take effect.


10. Governing law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.
